Defendant argued that the state failed to establish that the comparison bullet was in the same condition as the bullet taken from the victim and therefore hould have been excluded. The expert testified to comparing the marks on the bullets and testified that the marks were identical. The court held that it is "inconceivable" that a person could have made identical markings on the bullet if not from the same gun and therefore the evidence was competent.
